Crux Labs – Privacy & Cookies Policy

The terms of this Privacy and Cookies Policy (the “Privacy Policy”) published at https://www.crux-labs.com/privacy govern the information practices followed by https://www.crux-labs.com (“Website”) and are covered under “Terms of Service” at https://www.crux-labs.com/tos.

Crux Labs Pte. Ltd. (hereinafter referred to as “Crux Labs”, “we”, “us” or “our”), is a private company limited by shares and incorporated under ACRA in Singapore with its office in Singapore. We operate and own the Website. We are concerned about your privacy and have provided this Privacy Policy to familiarize you with the treatment of information collected by the Website.

Reference to “you” in this Privacy Policy refers to the users of this Website whether or not you access the services available on the Website or consummate a transaction on the Website.

This Privacy Policy discloses the information practices for the Website, including the type of information collected, how the information is collected, how the information is used and with whom it is shared. By using or accessing this Website, you agree to the terms and conditions of this Privacy Policy. You also expressly consent to our use and disclosure of your Personal Data (as defined below) in any manner as described in this Privacy Policy and further signify your agreement to this Privacy Policy and the Terms of Service (being incorporated by reference herein). 1. Definitions

A.Force Majeure Event” shall mean any event that is beyond our reasonable control and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action or any kind, riots, insurrection, war, acts of government, computer hacking, unauthorized access to your mobile or storage device, crashes, breach of security and encryption.

B.Products” refers to Crux Labs’ products and services rendered on the Website.

C.Third Party” refers to any person or entity other than you or us.

D.Third Party Account” refers to online accounts you may have with Third Party service providers or Social Networking Sites (“SNS”, e.g. Facebook, LinkedIn, Twitter, etc).

E.Personal Data” refers to any information that identifies or can be used to identify, contact or locate the person, to whom such information pertains including, but not limited to, name, address, phone number, fax number, email address, identification number or documents and credit card information and any other information disclosed by you in relation to the services available on the Website.

F.Usage Data” refers to non-Personal Data how the Website is accessed and used. This may include information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Website that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

2. Collection and Use of Information

Crux Labs has structured its Website such that visitors may browse without revealing personally identifiable information. Crux Labs uses information it collects to provide and collect payment for its products and other services. Passively collected information, such as information collected from or about your device including through the placement or reading of cookies or other tracking technologies is used to provide a customized experience as you use Crux Labs’ services.

Crux Labs does NOT trade, rent or sell your Personal Data to any other organization or Third Party, except as provided specifically in this Policy.

2.1 Types of Data Collected

We collect several different types of information for various purposes to provide and improve our Website experience for you, as detailed below.

2.1.1 Personal Data

While using our Website, we may ask you to provide us with certain Personal Data that may include, but is not limited to:

Sharing Personal Data with Third Party service providers in relation to the services available on the Website: To the extent necessary to provide you with the services on the Website, we may provide your Personal Data to Third Party contractors who work on behalf of or with us to provide you with such services, to help us communicate with you or to maintain the Website. Generally these Third Party contractors do not have any independent right to share this information. 2.1.1.1 Personal Data provided by you in relation to the use of the Website

In order for you to access and purchase Products on the Website, we may collect your Personal Data as may be required for the purposes connected thereto. We may be required to disclose such Personal Data to the Third Parties solely in connection with purchase, sale and delivery of Products list on the Website in accordance with the terms and conditions stipulated by such Third Party or regulatory compliance.

2.1.1.2 Personal Data provided by you in relation to the registration process

In order to provide you a safe, efficient, smooth and customized experience and in order to take advantage of certain features available on the Website including, but not limited to, making enquiries about products listed, subscribing to newsletters, public forums, accessing or uploading reviews or taking part in surveys, you will be asked to complete an online registration form which will provide us with Personal Data. In the event you register with us, you will also be asked to choose a user identity and password in order to identify yourself during future uses of the Website.

You may also register to join by logging into Third Party Account, via our Website as described below. As part of the functionality of the Website, you may link your account with Third Party Accounts, by either:

A. providing your Third Party Account login information to us through the Website; or

B. allowing us to access your Third Party Account, as is permitted under the applicable terms and conditions that govern your use of each Third Party Account.

You represent that you are entitled to disclose your Third Party Account login information to us and/or grant us access to your Third Party Account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable Third Party Account and without obligating us to pay any fees or making us subject to any usage limitations imposed by the applicable SNS. If you decide to register by logging into a Third Party Account via our Website, we will obtain the Personal Data you have provided to the applicable SNS (such as your “real” name, email address, profile picture, names of SNS friends, names of SNS groups to which you belong, other information you make publicly available via the applicable SNS and/or other information you authorize us to access by authorizing the SNS to provide such information) from your Third Party Accounts and use that information to create your account and profile page and you will become a member. Depending on the Third Party Accounts you choose and subject to the privacy settings that you have set in such Third Party Accounts, you understand that by granting us access to the Third Party Accounts, we will access, make available and store (if applicable and as permitted by the SNS and authorized by you) the information in your Third Party Accounts so that it is available on and through your account on the Website. If there is information about your “friends” or people with whom you are associated in your Third Party Account, the information we obtain about those “friends” or people with whom you are associated, may also depend on the privacy settings such people have with the applicable SNS.

We also collect the information that is not Personal Data that you provide as part of registration and the administration and personalization of your account profile.

All registered users of the Website may review, update, correct or delete the Personal Data in their registration profile by contacting the designated PDPO at Crux Labs or editing the relevant part of their profile. If you would like us to cancel your account, please contact us or select the “Cancel Account” feature available on your profile and we will attempt to accommodate your request if we do not have any legal obligation or a legitimate business reason to retain the information contained in your account. Please note that, if you cancel your account, any reviews you have posted via the Website will remain publicly viewable via the Website. While we recommend that you register yourself with us to maximize your experience on the Website, this feature is optional and you may opt out of registering on the Website and continue to use the Website as a guest. However, if you choose to buy products or services on the Website, you will have to provide certain Personal Data such as your billing address, credit / debit card details and such other information that is necessary for us to process and complete delivery.

2.1.2 Usage Data

We may also collect non-Personal Data how the Website is accessed and used. This Usage Data may include information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Website that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

2.1.2.1 Cookies

We use cookies and similar tracking technologies to track the activity on our Website and hold certain information. Cookies are files with small amount of data which may include an anonymous unique identifier. Cookies are used to record various aspects of your visit and assist us to provide you with uninterrupted service. Cookies may be set in your browser by us when you visit our Website or may be set in when you visit Third Party websites. This anonymous information is maintained distinctly and is not linked to the Personal Data that you submit to us. We also use cookies collected from the Website and Third Party websites to:

2.1.2.2 Other Tracking Data

In addition to Cookies, we may also collect information to enable us to better understand you so that we can improve your user experience; to assist our customer service and technical support personnel; and put processes in place to prevent fraud and unlawful use. In an effort to make our Website effective and improve the Website, certain information may be collected each time you access the Website. Such information may be saved in server logs in an encrypted form which may not identify you personally. Such information or data may include, but shall not limit to, IP address, your server details, and duration of your visit, date, time or purpose. Tracking technologies also used are beacons, tags, logs and scripts to collect and track information and to improve and analyze our Website.

2.2 Use and Handling of Data

We make all effort to ensure that we collect only such Personal Data that we believe to be relevant in order to record, support, and facilitate your transactions on the Website.

2.2.1 Customer Contact and Account Information

The information collected from customers is used to manage each customer’s account (e.g., billing and account management) and to promote other products or services that Crux Labs believe may be of interest to its customers. Crux Labs may also generate non-identifying and aggregate profiles from information that customers provide during registration and account creation. Crux Labs may use this aggregated and non-identifying information to promote advertisements that appear on Crux Labs’ website and in connection with its services. All such aggregated and non-identifying information that Crux Labs collects, as well as any analysis of such information that Crux Labs produces, is proprietary information of Crux Labs.

2.2.2 Analytics and Statistics

Crux Labs uses information gathered from its website analytics (e.g., user IP addresses) to help diagnose problems with Crux Labs’ servers, and to administer and optimize Crux Labs’ website. Crux Labs also collects broad demographic information from this data to help improve its website and services. Any statistics gathered by Crux Labs are proprietary property of Crux Labs.

2.2.3 Support and Email Inquiries

When customers send email inquiries and/or support requests to Crux Labs, the return email address (and other Personal Data provided in the inquiry/request) is used to answer the email inquiry/request received.

2.2.4 Customer Surveys

Crux Labs may use the contact information provided in customer surveys to follow up on survey answers. Crux Labs may also contact you to highlight the changes Crux Labs makes in response to your feedback.

2.2.5 Comments

When visitors leave comments on Crux Labs products and posts, the data shown in the comments form, the visitor’s IP address and browser user agent string, are used to detect spam. An anonymized string created from the email address (also called a hash) may be provided to the Gravatar service to see if you are using the Gravatar service. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of visitor and customer comments, their profile picture is visible to the public in the context of their comment.

2.2.6 Media

If visitors or customers upload images to Crux Labs, they should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

2.2.7 Contact Forms

Personal Data is captured when someone submits a contact form. We keep the contact form submissions for customer service purposes, and do not use the information for marketing purposes, unless the visitor or customer has explicitly indicated agreement to subscribe to our updates and news.

2.2.8 Embedded content from other websites

Crux Labs may provide information through blog posts and other linked objects that may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

2.3 Transfer of Data

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. If you are located outside Singapore and choose to provide information to us, please note that we transfer the data, including Personal Data, to Singapore and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer. Crux Labs Pte. Ltd. will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other Personal Data.

2.4 Disclosure of Data

In the event we are required to respond to subpoenas, court orders or other legal process and regulatory compliance, your Personal Data may be disclosed pursuant to such subpoena, court order or legal process, which may be without notice to you.

2.4.1 Legal Requirements

We may disclose your Personal Data in the good faith belief that such action is necessary to:

B. To protect and defend the rights or property of Crux Labs Pte. Ltd.

C. To prevent or investigate possible wrongdoing in connection with the Website

2.5 Confidentiality and Security of Data

Crux Labs uses multiple security measures to prevent the loss, misuse and alteration of the information under our control. Your data is protected using Secure Socket Layer (SSL) encryption technology, the industry standard. This encrypts order data and is designed to aid in ensuring the accuracy and security of that customer information. In the unlikely event of a data breach, Crux Labs will notify the appropriate regulatory and/or legal authorities, as well as affected customers/individuals, within seventy-two (72) hours.

We strive to ensure the security, integrity and privacy of your Personal Data and to protect your Personal Data against unauthorized access or unauthorized alteration, disclosure or destruction. With the exception of trusted business partners who work with or on behalf of Crux Labs, and are subject to specific confidentiality agreements, Crux Labs will not provide or sell to any Third Party your Personal Data and will keep all customer information confidential, subject to the following:

A. Crux Labs does not share Personal Data about individual users with advertisers. Crux Labs may display online advertisements and share aggregated and non-identifying information about customers collected through the registration process or through online surveys and promotions with certain advertisers. This aggregated and non-identifying information may be used to deliver tailored advertisements.

B. Crux Labs may share aggregated, non-personally identifying information obtained from customer surveys with third parties.

C. Crux Labs may access, preserve and share customer information with companies, organizations, governmental entities, or individuals outside of Crux Labs if we believe, in good faith and in our sole discretion, that the law requires us to do so. This may include, but is not limited to, responding to subpoenas, court orders or other legal processes. Crux Labs may access, preserve, and share customer information as necessary to: establish or exercise Crux Labs’ legal rights or defend against any claim including threatened claims; investigate, prevent, or take an action regarding suspected fraud or other illegal activities; prevent death or serious physical harm to any person; or investigate violations of Crux Labs’ Terms of Service.

The security of your data is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

2.6 Third Party Apps and Service Providers

Our Website may contain links to other sites that are not operated by us. If you click on a Third Party link, you will be directed to that Third Party’s site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any Third Party sites or services.

Link to Third Party apps and websites: The Website and any communication sent to you may also contain/display Third Party advertisements and links to other websites or products and services. 2.6.1 Analytics

We may use third-party Service Providers to monitor and analyze the use of our Website.

2.6.1.1 Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Website. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. You can opt-out of having made your activity on the Website available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity. 2.6.2 e-Commerce

2.6.2.1 WooCommerce

Our online store uses WooCommerce platform. Please read the following sub-sections carefully which cover additional information about collection and handling of Personal Data and Usage Data with Third Parties.

2.6.2.1.1 What information we collect and store?

While you visit our site, we’ll track:

A. Products you’ve viewed: we’ll use this to, for example, show you products you’ve recently viewed

B. Location, IP address and browser type: we’ll use this for purposes like estimating taxes and shipping

C. Shipping address: we’ll ask you to enter this so we can, for instance, estimate shipping before you place an order, and send you the order!

D. We’ll also use cookies to keep track of cart contents while you’re browsing our site.

When you purchase from us, we’ll ask you to provide information including your name, billing address, shipping address, email address, phone number, credit card/payment details and optional account information like username and password.

We will use this information for purposes, such as, to:

If you create an account, we will store your name, address, email and phone number, which will be used to populate the checkout for future orders.

We generally store information about you for as long as we need the information for the purposes for which we collect and use it, and we are not legally required to continue to keep it. For example, we will store order information for 5 years for tax and accounting purposes. This includes your name, email address and billing and shipping addresses. We also store comments or reviews, if you choose to leave them.

2.6.2.1.2 Who on our team has access to the collected information?

Members of our team have access to the information you provide us. For example, both Administrators and Shop Managers can access:

A. Order information like what was purchased, when it was purchased and where it should be sent, and

B. Customer information like your name, email address, and billing and shipping information.

Our team members have access to this information to help fulfill orders, process refunds and support you.

2.6.2.1.3 Payments

We accept payments through PayPal. When processing payments, some of your data will be passed to PayPal, including information required to process or support the payment, such as the purchase total and billing information. Please see the PayPal Privacy Policy for more details.

2.6.3 Media

2.6.3.1 YouTube

Our website uses plugins from YouTube, which is operated by Google. The operator of the pages is YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. If you visit one of our pages featuring a YouTube plugin, a connection to the YouTube servers is established. Here the YouTube server is informed about which of our pages you have visited. If you’re logged in to your YouTube account, YouTube allows you to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account. YouTube is used to help make our website appealing. This constitutes a justified interest pursuant to Art. 6 (1) (f) DSGVO.

2.6.3.2 Vimeo

Our website uses features provided by the Vimeo video portal. This service is provided by Vimeo Inc., 555 West 18th Street, New York, New York 10011, USA. If you visit one of our pages featuring a Vimeo plugin, a connection to the Vimeo servers is established. Here the Vimeo server is informed about which of our pages you have visited. In addition, Vimeo will receive your IP address. This also applies if you are not logged in to Vimeo when you visit our plugin or do not have a Vimeo account. The information is transmitted to a Vimeo server in the US, where it is stored. If you are logged in to your Vimeo account, Vimeo allows you to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your Vimeo account.

2.6.3.3 Google Web Fonts

For uniform representation of fonts, this page uses web fonts provided by Google. When you open a page, your browser loads the required web fonts into your browser cache to display texts and fonts correctly. For this purpose, your browser has to establish a direct connection to Google servers. Google thus becomes aware that our web page was accessed via your IP address. The use of Google Web fonts is done in the interest of a uniform and attractive presentation of our plugin. This constitutes a justified interest pursuant to Art. 6 (1) (f) DSGVO. 2.6.3.4 SoundCloud

On our pages, plugins of the SoundCloud social network (SoundCloud Limited, Berners House, 47-48 Berners Street, London W1T 3NF, UK) may be integrated. The SoundCloud plugins can be recognized by the SoundCloud logo on our site. When you visit our site, a direct connection between your browser and the SoundCloud server is established via the plugin. This enables SoundCloud to receive information that you have visited our site from your IP address. If you click on the “Like” or “Share” buttons while you are logged into your SoundCloud account, you can link the content of our pages to your SoundCloud profile. This means that SoundCloud can associate visits to our pages with your user account. 5. Customer Options

5.1 Public Forums

Be advised that any information you may disclose or post in forums or other public areas of Crux Labs’ website or the Internet, becomes public information. You should always exercise caution when deciding to disclose Personal Data in these public areas. To request removal of your Personal Data from Crux Labs community forums or testimonials, contact the designated PDPO at Crux Labs. In some cases, Crux Labs may be unable to remove your Personal Data, in which case Crux Labs will let you know why it is unable to do so.

5.2 Unsubscribe/Opt-out

When you become a customer of Crux Labs, you are automatically subscribed to receive transactional notices and updates about your account, email newsletters and news of special promotions offered through Crux Labs and/or in conjunction with Crux Labs’ partners. To unsubscribe from Crux Labs’ newsletters and promotional mailings, customers may update their preferences on the Account Manager. Customers may also unsubscribe through the links provided in promotional email messages sent by Crux Labs or on Crux Labs’ behalf.

5.3 Accessing & Modifying Your Information

Crux Labs allows customers to access, update, and correct inaccuracies in your Personal Data in Crux Labs’ custody and control, subject to certain exceptions prescribed by law. Crux Labs also allows individuals and customers to delete their Personal Data which is in Crux Labs’ custody and control, by requesting erasure of the same. 7. Age

Crux Labs does not sell products or services for purchase by children. Customers must be at least 18 years of age. Any individual under the age of 18 (“Minor”) must have a parent or guardian accept the Terms of Service in order for the Minor to become a Customer.
